The following describes a automobile case handled by Mr. Shoenfelt:
Case 1
A bulldozer backed into a truck hauling concrete on a jobsite. The cab of the truck was damaged and the driver, who had undergone previous neck surgery, was injured in the accident. On the day of the accident both OSHA and company policy required a flagman to be posted near the work area. The flagman posted at the area had gone to the restroom and testified that he told the bulldozer operator not to move the bulldozer. Plaintiff’s physician testified that subsequent neck fusion was necessary due to the accident at the plant. The plaintiff had also not returned to work in over three years, and it was unlikely that he would be able to return to his previous employment. The case was settled by the defendant for the employers of the flagmen for a total of $575,000. |
